American Canyon I, LLC (AC1) respectfully submits this comment regarding Agenda Item 14. AC1 is not opposed to development, annexation, transportation improvements, or long-range housing planning. Our concern is procedural: the City’s current agenda materials show that the proposed Urban Limit Line and Regional Housing Needs Allocation Agreement is premised on expanding the existing 2008 Urban Limit Line (“ULL”) to include the Hess-Laird Affected Territory (“HLAT”), which the City’s own documents acknowledge is outside the existing ULL.
The Staff Report, proposed agreement, and proposed resolution all characterize the action as an actual expansion of the ULL, not a ministerial implementation of the existing line, a clarification of an ambiguous boundary, or an annexation of land already within the ULL.
That creates a legal problem under the operative 2008 ULL documents. Resolution 2008-105 states that the ULL amendment had to be affirmed through an initiative, that the initiative established a ULL that may not change prior to 2030, and that any modification of the ULL would require a subsequent vote. Exhibit A to that resolution, the City of American Canyon Urban Limit Line and Prezoning Act, is even more direct: Section 2(h) states that the ULL cannot be changed without a vote of the voters of the City at a subsequent City election, and Section 9 states that the ULL remains in effect until January 1, 2030.
Accordingly, the City should not approve Item 14 to the extent it is based on expansion of the 2008 voter-adopted ULL without voter approval. The City cannot do indirectly through an intergovernmental agreement, RHNA transfer, annexation support, tax-sharing framework, or Council resolution what the 2008 initiative forbids it from doing directly.
If the City wishes to expand the ULL to include the HLAT, the proper course is to submit that proposal to the voters at a subsequent City election, consistent with the restrictions adopted in 2008. We respectfully ask that this comment be included in the administrative record for Item 14.

I would like to express my support for the proposed expansion of city limits northerly to South Kelly Road.
Thoughtful growth is essential for the long-term sustainability of our community. Expanding in this area presents an opportunity to plan responsibly—allowing for improved infrastructure, housing options, and economic development while maintaining the character and values that make our city special.
This expansion can help address current and future needs, including safer roadways, better access to services, and opportunities for local businesses to grow. With careful planning and community input, we can ensure that this development benefits both current residents and future generations.
I encourage the Council to continue prioritizing transparency, environmental responsibility, and community engagement throughout this process.
